Vietnam Overstay Fines in Nha Trang by Days Overstayed
A foreigner who overstays pays a fine set by how long the stay ran past its term. It is VND 500,000 to 2,000,000 for under 16 days. It is VND 30,000,000 to 40,000,000 for 1 year or more. Deportation may be added for violations in clauses 4 to 9 of Article 21.

Decree 282/2025/NĐ-CP sets the fine by how many days you stay past your permitted term. It replaces Decree 144/2021/NĐ-CP and took effect on 15 December 2025.
Which case are you?
- Overstayed by under 16 days: you fall in the lowest band, VND 500,000 to 2,000,000. Report to the provincial immigration office where you stay.
- Overstayed by 16 days or more: the bands rise from VND 5,000,000 to 10,000,000 to VND 30,000,000 to 40,000,000 at 1 year or more. Deportation may also be added.
- Stay has ended and you have not left: forced exit can be ordered. Re-entry is then refused for 6 months.
- Already hold a fine decision: pay within 10 days of receiving it, unless the decision states a longer deadline.
- Stay has not ended yet: leave before it ends, or have your sponsor file an extension well before then.

What counts as overstaying
Overstaying starts the moment your permitted stay ends. That can be the period granted at the border, an extension of it or a temporary residence card. For a visa holder, the period granted at the border equals the visa’s validity.

A DL tourist visa valid for more than 30 days is the exception. The stay granted at the border is 30 days, with an extension considered.
If you entered visa-free under the 45-day scheme, your period is 45 days from entry. The scheme for 12 named countries runs from 15 March 2025 to 14 March 2028. Check the exact expiry date on your entry stamp or e-visa.
DL and EV visas, like HN visas, are valid for a maximum of 90 days. Plan the exit before the last day, not on it.
Fine bands by days overstayed
| Days past the term | Fine (VND) |
|---|---|
| Under 16 days | 500,000 to 2,000,000 |
| 16 days to under 30 days | 5,000,000 to 10,000,000 |
| 30 days to under 60 days | 10,000,000 to 15,000,000 |
| 60 days to under 90 days | 15,000,000 to 20,000,000 |
| 90 days to under 180 days | 20,000,000 to 25,000,000 |
| 180 days to under 1 year | 25,000,000 to 30,000,000 |
| 1 year or more | 30,000,000 to 40,000,000 |

Each band applies to a foreigner staying past a temporary residence certificate, extension or temporary residence card without permission from the competent authority.
Overstaying is treated as a violation from the first day, even if it is only one day. The specific fine is the midpoint of the band, and mitigating circumstances can lower it but not below the band minimum. Aggravating circumstances can raise it but not above the band maximum.
An organisation found responsible for the same violation is fined at double the individual rate. Accommodation providers that fail to register foreign guests face their own fines.
Deportation and re-entry bans
Deportation may be added as a penalty for violations in clauses 4 to 9 of Article 21. Clause 4 is the 16 days to under 30 days band in the table above. The decision rests on the nature, severity and consequences of the violation.

A foreigner deported from Vietnam is refused entry for 3 years from the date the deportation decision took effect.
A foreigner forced to leave Vietnam is refused entry for 6 months from the date the forced-exit decision took effect.
Ignoring a deportation decision, a forced-exit decision or an exit request and continuing to reside in Vietnam is fined VND 30,000,000 to 40,000,000.
The authority also weighs the offender and any mitigating or aggravating circumstances when it decides on deportation.
Forced exit and deportation are different measures with different re-entry bans. Deportation is an extra penalty, decided case by case. Forced exit rests on the stay having ended without departure.
The base legal ground for forcing an overstayer to leave is that the temporary-residence period has ended and they have not left. When a fine decision carries deportation and the violator has no means to pay, deportation is carried out immediately if national security, public order or social safety so require.
Paying the fine and leaving the country
You must pay within 10 days of receiving the fine decision, unless the decision states a longer deadline.
The fined person pays at the State Treasury, or into the State Treasury account named in the decision. A fine collector must give the payer a payment document.
Since 1 July 2025, a penalty can be issued without a written record only for a warning or a fine up to VND 500,000 for an individual. In those cases the officer issues the decision on the spot.
A temporary exit suspension cannot exceed 3 years, though it can be extended. An unpaid fine can block your exit. A foreigner who still has an administrative-penalty decision to fulfil can be temporarily barred from leaving Vietnam.

In Nha Trang, ask at the provincial immigration office; its address is on the Nha Trang immigration office page. As general practice, a Tay Ninh police article advises an overstayer to go promptly to the Immigration Management Office of the provincial or city police where they stay. There they report, pay the fine and get guidance.

Other fines that often come with an overstay
Whoever lets a foreigner stay while the foreigner resides unlawfully, or sees signs of a violation and does not report it, is fined VND 20,000,000 to 25,000,000. That covers employing a foreign worker, housing a foreigner or organising a tour.

A foreigner who works in Vietnam without permission from a competent authority is fined VND 15,000,000 to 20,000,000. Acting against the purpose declared for the visa, card or extension is fined VND 20,000,000 to 25,000,000.
A foreigner who does not present their passport or residence papers when an authority asks is fined VND 500,000 to 2,000,000.
A foreigner who walks around Vietnam without a passport, travel document or residence papers is warned or fined VND 300,000 to 500,000. Accommodation that fails to declare 4 to 8 foreign guests is fined VND 10,000,000 to 15,000,000. For 9 or more guests the fine is VND 15,000,000 to 20,000,000.

Step by step after an overstay

- Act at once. Overstaying counts as a violation from the first day.
- Report in person. Go to the Immigration Management Office of the provincial or city police where you stay, to report, pay the fine and get guidance.
- Receive the decision. A penalty decision may be issued on the spot only for a warning or a fine up to VND 500,000 for an individual. A larger fine follows the normal written-record route.
- Pay. Pay within 10 days of receiving the decision, at the State Treasury or into the account named in it.
- Get the payment document. The person who collects the fine must give the payer one.
- Leave, or follow the decision. An unpaid fine can block your exit.
What follows each situation

|---|---|---|

| Overstay of 16 days or more | Deportation may be added | Re-entry refused for 3 years |

| Deportation ordered and no means to pay | Deportation carried out immediately | Fine enforcement ends once deportation is carried out |

The table covers the foreigner. A sponsoring organisation found responsible is fined at double the individual rate.
Avoiding an overstay
Extend before the term ends. Your sponsor files the extension request, not you. Processing takes no more than 5 working days from a complete dossier, and the fee is US$10.

A Vietnamese individual sponsor must be a grandparent, parent, spouse, child or sibling and show proof. The request can be filed in person, online or by post. The extension form is NA5.
If the application is refused or you decline the result, the fee already collected is not refunded.

Not confirmed: Which Khanh Hoa office takes the report and fine payment has no Khanh Hoa official source, so ask the Nha Trang immigration office.
